Terms of Service

Draft — not in force. The operating entity, address, governing law and effective date are not yet set, and this text has not been reviewed by a lawyer. It describes how the service actually behaves, which is the useful half, but it is not a binding agreement and must not be presented as one.

These terms cover your use of Encrypt.to. By creating an account you agree to them. If you do not, do not use the service.

What the service does

You upload documents, which are encrypted in your browser. You name recipients and set a check-in interval. If you stop checking in, we send reminders, wait out a grace period, hold for a further 48 hours, and then send each recipient a link to the documents you assigned them. Any check-in at any point resets the clock.

This is not a will, and we are not your lawyer

Encrypt.to is a delivery mechanism, not a legal instrument. Nothing you store here has testamentary effect, and using it does not create a will, a trust, a power of attorney, or any other legal document. It does not replace an executor, a solicitor, or a probate process. If you are planning an estate, get advice from someone qualified to give it and treat this service as a way of getting material to people, not as the plan itself.

What we do not promise

We may fail to deliver. Software has defects, providers have outages, email is unreliable, addresses go stale, and companies close. We build carefully — the system refuses to fire when it cannot prove it was reachable, and it will not treat a failed send as a delivered one — but we cannot guarantee that a delivery will happen, or happen on time. Do not rely on this service as the only route by which something important reaches someone.

We may deliver in error. A defect, or a period in which you were alive but genuinely unable to check in, could cause documents to be sent when you did not want them sent. A delivery cannot be recalled. Choose what you store here with that in mind.

Your responsibilities

  • Keep your password and your 15-word recovery code safe. We cannot reset your password and cannot recover your documents without one of them — that is a consequence of not being able to read them, not an oversight.
  • Check in. Reminders go to the email address on your account, so keep it current and reachable.
  • Choose recipients carefully, and make sure you are entitled to give us their contact details for this purpose.
  • Do not use the service to store or transmit anything unlawful, or to harass anyone.

Open Link recipients

If you designate a recipient as an Open Link, documents assigned to them are readable by us and could be produced under legal compulsion. The product tells you this at the point of choosing, and requires you to acknowledge it. By choosing it you accept that the zero-knowledge protection does not apply to those documents.

Recipients did not sign up

People you name have no account and have agreed to nothing. If a delivery happens they will receive an email they did not ask for. They may contact us at support@encrypt.to and ask what we hold, and ask us not to contact them again — which may mean a delivery you intended cannot be completed.

Subscription

Encrypt.to is a paid subscription. The base plan includes 100 MB of encrypted storage; larger allowances cost more. You can move to a smaller plan once your stored data fits inside it — we will never delete your documents to make a downgrade possible.

Not yet settled: what happens to an armed trigger if a subscription payment fails. This is the most consequential clause in this document and it will not be written until it has been decided deliberately. Until it is published here, treat the answer as undefined and do not rely on either outcome.

Ending the agreement

You may close your account at any time, which deletes your documents and disarms your trigger. We may suspend or close an account that breaches these terms, or discontinue the service; if we discontinue it we will give you reasonable notice and time to retrieve your documents.

Liability

To the extent the law allows, [the operator — TO BE SET] is not liable for indirect or consequential loss arising from use of the service, including loss resulting from a delivery that did not happen, happened late, or happened when it should not have. Nothing here limits liability that cannot lawfully be limited. Some jurisdictions do not allow these limits, in which case they apply only as far as permitted.

Changes and governing law

We may update these terms; material changes will be notified by email to the address on your account. These terms are governed by the law of [governing jurisdiction — TO BE SET].
